In 1973, Costa Rica enacted laws governing the ownership, sale and purchase of coastal real estate. The coastline is legally defined as a strip of land two hundred meters wide, starting from the line marked by the lowest tide and moving inwards by two hundred metres. Of these two hundred meters, the first fifty are public property/public lands and therefore cannot be owned by any individual or legal entity. Access to this 50 meter long track is open to the public as it is intended for public use. The management of the remaining 150-meter-wide strip, also known as the “Reserved Area”, is entrusted to local governments, which can grant concessions for use. These rules are regulated by the “Law on the Coastal Zone” (in Spanish: “Ley de Zona Marítimo Terrestre”), which establishes a series of conditions and rules regarding the use of concessions granted in the sea-land zone. Some of these terms and conditions are described below.
The Shoreline Zone Act states that the following persons and entities cannot obtain permits in the Shoreline Zone: i- foreigners who have not resided in the country for at least five years; ii- companies with bearer shares; iii- companies registered or based abroad; iv- companies and entities established by foreigners; and v-companies where more than fifty percent of the capital is owned by foreigners. The Costa Rican Congress is currently debating new legislation aimed at removing prohibitions limiting the issuance of permits to foreigners to use coastal areas.
The procedure to be followed when allocating land or a concession is mainly to submit an application to the local municipality. The application will be reviewed and the land inspected, and if it is approved, the local municipality will issue a notice, which must be published in the official newspaper, giving interested parties the opportunity to express concerns, complaints or objections regarding rights of use that may have been held previously. existed. Once this procedure is completed, the municipality will be able to adopt a resolution approving the concession and authorizing the preparation of an agreement with the selected beneficiary, which must also be approved and signed by the Costa Rica Tourism Board. Once this agreement is signed, the notary must notarize the agreement and submit it to the Concession Register of the Public Registry of Costa Rica to ensure that the grant is protected against potential future claims by third parties.

Concessions are granted for a period of five to thirty years, with the possibility of extending them for equal periods, if the concessionaire has fulfilled the requirements set by the Municipality and paid the set concession fees on the required dates.
When announcing the concession, the Municipality establishes an annual canon (recurring tax liability), which the beneficiary must pay in order to be able to exercise the rights that the Municipality has granted him.
